Acceptance of Terms

By downloading, installing, or using Vibrant Frog Collab (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

Vibrant Frog Collab is a writing assistance application that allows users to create and edit documents, transcribe handwritten text using AI, and generate quote images. The App requires users to provide their own API keys (for OpenAI and Anthropic) or authenticate via OAuth (for Google Gemini) to access third-party AI services.

User Responsibilities

You are responsible for:

Providing and maintaining valid API keys or OAuth authentication for any third-party AI services you wish to use
All costs and charges associated with your use of third-party AI services
Complying with the terms of service of any third-party AI providers you use through the App
All content you create, upload, or process through the App
Maintaining the security and confidentiality of your API keys and account credentials
Ensuring your use of the App complies with all applicable laws and regulations

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, Frog Team AI disclaims all warranties, express or implied, including but not limited to:

Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
Warranties that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components
Warranties regarding the accuracy, reliability, or completeness of any AI-generated content
Warranties regarding the availability or performance of third-party AI services

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FROG TEAM AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

In no event shall Frog Team AI's total liability to you for all claims arising from or related to the App exceed the amount you paid for the App, if any, or fifty dollars ($50 USD), whichever is greater.

This limitation applies to:

Any errors, inaccuracies, or omissions in AI-generated content
Loss of data or documents
Costs incurred from third-party AI service usage
Unauthorized access to your API keys, OAuth tokens, or content
Any interruption or cessation of the App's functionality
Any bugs, viruses, or other harmful code that may be transmitted through the App

AI-Generated Content

You acknowledge and agree that:

AI-generated content may contain errors, inaccuracies, or inappropriate material
You are solely responsible for reviewing and verifying all AI-generated content before use
Frog Team AI does not guarantee the accuracy, quality, or appropriateness of any AI-generated content
AI responses are generated by third-party services and Frog Team AI has no control over their output

Third-Party Services

The App integrates with third-party AI services including OpenAI, Anthropic, and Google. Your use of these services is subject to their respective terms of service and privacy policies. Frog Team AI is not responsible for:

The availability, performance, or reliability of third-party services
Any changes to third-party service pricing, terms, or functionality
Any actions taken by third-party services regarding your account, API keys, or OAuth access
Content generated by third-party AI services

Intellectual Property

You retain ownership of all content you create using the App. By using the App, you grant Frog Team AI no rights to your content. The App itself, including its design, features, and code, remains the property of Frog Team AI.

Indemnification

You agree to indemnify, defend, and hold harmless Frog Team AI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

Your use of the App
Your violation of these Terms
Your violation of any third-party rights
Content you create, upload, or process through the App

Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for any reason. Upon termination, your right to use the App will immediately cease.

Changes to Terms

We may modify these Terms at any time. Continued use of the App after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between you and Frog Team AI regarding your use of the App and supersede any prior agreements.
